Blog 1: Court Blocks Cross-State Pollution, 8/30/12

       Federal appeals court came up with a decision on how much air pollution that states would have to clean up to prevent problems in other downwind states. The reason "The Cross Air-Pollution Rule" was recommend was to try to get the upwind states to take fair amount of responsibility as the downwind states for pollution. The north wind states would always meet sanitation level but the north wind states contain power plants and other industrial plants that had nitrogen oxide and sulfur dioxide that would sip down the downwind states and pollute their environment. This rule was made to improve the "Clean Air Act" made in 2005. Environmental Protection Agency also made an attempt to try to get upwind states to put their plants in a place where it would be less of a chance for the downwind states to get polluted with sulfur or nitrogen.
      The act of "The Cross Air-Pollution Rule" was over-ruled 2 to 1. The United States Courts of appeal said that the environmental protection agencies were exceeding their power by trying to get 28 upwind states to clean up. The EPA's rule was known to have violated the "Clean Air Act" because; it did not allow other states to submit their own plan so they can impose a federal plan. The Environmental Protection Agency are saying this rule not being passed might really affect downwind states based on environmental issues. Some companies disagreed with the E.P.A and so this a dozen other States including North Carolina. Mary Hitt is a director of the group "beyond a coal company" and she said that the rejection of the act will further delay the process of cleaner air and also she goes on to say the rule would prevent about 34,000 premature deaths.
